SMS opt-in and consent

FinalKey sends text messages for one reason only: to deliver the secret code that lets a family member verify an end-of-life request. Every recipient is named by a FinalKey user, and every recipient must reply YES before we send them anything else. We never send marketing texts, and we never share phone numbers.

Express written consent required No marketing, ever Effective December 1, 2025
Screenshot of the FinalKey app's Confirm SMS Consent screen, shown when a user adds a Secret Code Recipient. It states that by adding the recipient the user confirms they have authority to share the phone number, previews the exact opt-in text message that will be sent, and explains that the recipient must reply YES before receiving anything else.
How consent is collected

Consent is captured in the app, then confirmed by the recipient

SMS consent for FinalKey happens in two places: the FinalKey user affirms they have authority to share the number, and then the recipient themselves must confirm by replying YES. No message beyond that single opt-in request is ever sent to an unconfirmed number.

The screen shown here is what a FinalKey user sees when adding a Secret Code Recipient in the app, under Settings → Secret Code Recipients. It displays the exact wording of the message that will be sent before the user proceeds.

  1. 1
    The user designates a recipient

A FinalKey user adds a trusted person as a Secret Code Recipient and enters their mobile number.

  2. 2
The user affirms authority and reviews the message

Before anything is sent, the user must confirm they have the authority to share that phone number with FinalKey and that the person expects to receive messages from us. The full text of the opt-in message is shown on screen.

  3. 3
The recipient receives one opt-in request

We send a single message identifying FinalKey, explaining why they were designated, and telling them how to confirm or decline.

  4. 4
The recipient replies YES — or nothing happens

Only after an explicit YES will FinalKey ever text that number again. A reply of STOP opts them out, and nothing further is sent unless they explicitly opt back in with START.

Message types

The only messages we send

All FinalKey SMS is transactional. There are no campaigns, no newsletters, and no recurring messages of any kind. These five message types are the complete set.

1 · Opt-in request

Confirmation request

"FinalKey: Jane has designated you as a Secret Code Recipient for their end-of-life plan. Reply YES to confirm. Reply STOP to decline and opt out. Msg&data rates may apply."

Sent once, when a FinalKey user first designates the number. If there is no YES, we send nothing further.

2 · Welcome

Opt-in confirmed

"FinalKey: You are confirmed as a Secret Code Recipient for Jane. If they pass, you may receive a one-time code to relay to their successor. Reply HELP for info, STOP to opt out."

Sent once, immediately after the recipient replies YES, so they understand what they have agreed to receive.

3 · One-time passcode

Secret verification code

"FinalKey end-of-life verification: a request has been filed claiming John Smith has passed. If you independently confirm this, share code 4829-7361 with the successor at +18175551234. Do not share if you are unsure. Reply STOP to opt out."

Sent only after a Successor files a death-verification request that has passed document-authenticity and database-match checks.

4 · Administrative

HELP reply

"FinalKey: You receive these messages because Jane designated you as a Secret Code Recipient. Questions: support@myfinalkey.com. Reply STOP to opt out. Msg&data rates may apply."

Our standard response to the HELP keyword, identifying why the recipient is receiving messages and how to reach us.

5 · Opt-out confirmation

STOP confirmed

"FinalKey: You have opted out and will no longer receive messages from this number. You can re-enroll at any time by asking the primary user to re-add you. Reply START to opt back in."

Our single confirmation after a STOP reply. Nothing further is sent to that number unless the recipient opts back in.

Our commitments

What we always do — and never do

We always

  • Require express opt-in via a YES reply before sending anything beyond the initial request
  • Identify FinalKey by name in every message
  • Honor STOP immediately, sending only a single opt-out confirmation afterward
  • Support the HELP keyword with real contact information and the reason for contact
  • Disclose that message and data rates may apply
  • Retain opt-out status until the recipient themselves opts back in with START

We never

  • Send marketing, promotional, or advertising messages
  • Send recurring campaigns, newsletters, or drip sequences
  • Share, sell, or rent phone numbers to third parties for marketing
  • Purchase or import phone number lists
  • Message a number that has not confirmed with YES
  • Message a number after it has replied STOP
Opting out

You are always in control

Two keywords, recognized on every message we send. No apps, no logins, no waiting on hold.

STOP

Reply STOP to any FinalKey message to opt out immediately. We'll send one confirmation and nothing after that. Reply START if you ever wish to opt back in.

HELP

Reply HELP for assistance, or email support@myfinalkey.com any time.

Message frequency varies and is transactional only. Message and data rates may apply. Carrier delivery is provided by Twilio; by opting in you consent to FinalKey and Twilio processing your phone number solely to deliver the messages described above. Phone numbers of Secret Code Recipients are retained for as long as the designating user keeps that designation active; opt-out status is retained indefinitely to honor the opt-out.
